1)There is a 2.25% Internet Purchase Fee charged on all online purchases up to $45,000.00 any purchases exceeding $45,000.00 will be charged a flat rate of $1,012.50 per unit. Taylor and Martin also charges a 1.5% Transaction Fee.

2) All non dealer residents are subject to a sales tax unless exemption forms are presented. All out of state residents are exempt from sales tax.

3)Payment in full must be made by September 27, 2012 in the form of Cash, Wire Transfer, Cashiers Check or a Company / Personal Check accompanied with a bank letter of guarantee.

4)All purchases must be removed from the premises by October 4, 2012.

5)Bidders are to be held personally liable for any bids made with their Bidding Number.

6)The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for re-sale.

7)The Auctioneer and TMILive.com accepts no liability for loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale.

8)The Auctioneer and TMILive.com has described the Lot(s) in the catalogue to the best of their ability and belief from information furnished by the Vendor(s) who shall be alone responsible for any error or miss-statement, which there may be. The Auctioneer and TMILive.com undertake no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalogue or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact.

9)Each and every Lot is sold as seen. The Auctioneer and TMILive.com provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by the Auctioneer and TMILive.com, its servants or agents are to be considered lay opinions only and the Auctioneer and TMILive.com accepts no liability for any purchase made by a Buyer in reliance upon them.

10)The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer.

11)The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth.

12)T&M shall not be liable or responsible for any interruptions, termination or corruption of any audio feed, video feed or of any other internet registration bidding or other online related servide that occurs before, during or in connection with the auction sale, regaurdless of the cause of fault attributable to the interruption, termination or corruption of such services.


13) “This agreement will be construed and governed according to the laws of the State of Nebraska and any disputes arising in connection with this agreement and auction shall be subject to the exclusive jurisdiction and venue of the state and federal courts of Nebraska.”

Complete payment due the day of sale by
cash ($1,000 deposit required), certified or cashier’s
check. Personal or company checks will be accepted if
accompanied by a letter of guarantee from your bank.
This letter of guarantee must include the following:
“(Your bank) will guarantee or honor your check up
to a specified amount for purchases made at this auction.”
All purchases are subject to verification with your
bank or financial institution. Immediate possession
of all equipment upon proper settlement.
There will be a two percent (2.0%) internet transaction fee on all online purchases up to $35,000.00, any purchases exceeding $35,000.00 will be charged a flat rate of $700.00 per unit. Taylor & Martins also charges a one
percent (1.0%) transaction fee charged to the buyer for all purchases.

If you are paying for your purchase with a
wire transfer, then at the discretion of Taylor &
Martin, a $10,000 deposit must be wire transferred
to us no later than 3:00 p.m. (central time) the day
before the auction. Your deposit will be applied to your
purchase. If you are not the successful bidder, your
