“Mr. (Customer Name) is a customer in good standing at our bank. We will guarantee the payment of checks on his account (account number) up to (specify amount) dollars for purchase at your auction in (Auction Location) on (Auction Date). We hereby agree that no stop payment will be issued in conjunction with this letter.” 1)There is a 2.25% Internet Purchase Fee charged on all online purchases. Taylor and Martin also charges a .25% Transaction Fee. 2) [Check on Applicable Sales Tax it goes here] Applicable State of IA Sales Tax will be charged on all Lots. Bidders from outside the State of IA will be exempt from Sales Tax if they provide proof an approved tax exemption status form and exception certificates that are acceptable to the State of IA. 3)Payment in full must be made by Febraury 11, 2010. In the form Cash, Wire Transfer, Cashiers Check or a Company Check accompanied with a bank letter of guarantee. 4)All purchases must be removed from the premises by Thursday Febraury 18, 2010. 5)Bidders are to be held personally liable for any bids made with their Bidding Number. 6)The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for re-sale. 7)The Auctioneer and TMILive.com accepts no liability for loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale. 8)The Auctioneer and TMILive.com has described the Lot(s) in the catalogue to the best of their ability and belief from information furnished by the Vendor(s) who shall be alone responsible for any error or miss-statement, which there may be. Payment Instructions:
Complete payment due the day of sale by cash ($1,000 deposit required), certified or cashier’s check. Personal or company checks will be accepted if accompanied by a letter of guarantee from your bank. This letter of guarantee must include the following: “(Your bank) will guarantee or honor your check up to a specified amount for purchases made at this auction.” All purchases are subject to verification with your bank or financial institution. Immediate possession of all equipment upon proper settlement. A One-Forth of one percent (.25%) transaction fee will be charged to the buyer for all purchases. Titles will be mailed. If you are paying for your purchase with a wire transfer, then at the discretion of Taylor & Martin, a $10,000 deposit must be wire transferred to us no later than 3:00 p.m. (central time) the day before the auction. Your deposit will be applied to your purchase. If you are not the successful bidder, your deposit will be refunded to you. This public consignment auction will feature many late model combines, tractors, grain trucks, planters and other farm implements. Equipment is from several equipment dealers and farm operations and is being sold to reduce excess inventory or as part of routine replacement programs. Everything sells “as is”, “where is”. The final bidder is required to pay for purchase regardless of its faults. The condition and serviceability of any piece of equipment is expressed only by the owners and absolutely no warranty or guarantee is given or implied.
